Amendments of the Advocacy Act

The latest amendments in the Bulgarian Advocacy Act were promulgated in the State Gazette today.

The amendments are intended to bring the Advocacy Act into compliance with Directive 98/5/EC of the European Parliament and of the Council of 16 February 1998.

The amendments introduce the possibility for lawyers from EU member states who belong to a grouping in their home member state to establish a branch in Bulgaria. Lawyers from EU member states are now allowed to form and/or participate in Bulgarian attorneys’ partnerships and companies. In addition, the business name of such attorneys’ companies can include the name of the EU member state grouping to which the participating EU member state lawyer belongs.

EU member state lawyers are now allowed to participate in and vote at the sessions of the professional lawyers’ organizations in Bulgaria.

There are also various other amendments which are intended to place EU lawyers and their groupings on equal footing with Bulgarian ones.
